These Terms of Use ("Terms") govern the access and use of AIRES AI (the "Service"), an AI-driven platform designed to support real estate professionals and wholesalers. By accessing or using the Service, you agree to comply with these Terms. Certain provisions may only apply to specific categories of users, such as Consumers or Business Users. 2. Definitions

AIRES AI: The software platform and AI tools owned and operated by AI Real Estate Solutions ("Owner").Service: The AI-driven platform, tools, and software provided by AIRES AI.User: Any person or entity that accesses or uses the Service, including Buyers, Sellers, and Business Users.Business User: Any User using the Service for commercial, business, or professional purposes.Content: All data, text, files, images, video, or other material uploaded, submitted, or generated using the Service.Owner: AI Real Estate Solutions, the provider and operator of AIRES AI.

3. Account Registration and User Responsibilities

3.1. Account Registration

Users must create an account to access certain features of the Service.You are responsible for maintaining the confidentiality of your login credentials and notifying AIRES AI immediately of any unauthorized use of your account.

3.2. User Responsibilities

Users must provide accurate and up-to-date information when creating an account.You are solely responsible for activities that occur under your account.Users may not share access to their accounts with third parties.

4. Licensing and Use of the Service

Users are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Service in accordance with these Terms.This license does not grant ownership of the software, source code, or any intellectual property of AIRES AI.Users may not attempt to copy, modify, reverse engineer, or distribute any part of the software.

5. Subscription, Billing, and Cancellation

5.1. Subscription and Payment Terms

Access to AIRES AI may require a subscription. Users will be notified of the subscription fee before purchase.Subscription payments are billed on a recurring basis (monthly or annually, as applicable) and will automatically renew unless canceled.By submitting payment information, you authorize AIRES AI to charge your payment method for all applicable fees.

5.2. Refund Policy

All payments are non-refundable unless otherwise stated in writing by AIRES AI.

5.3. Subscription Cancellation

Users may cancel their subscriptions at any time by accessing their account settings or contacting AIRES AI support.Cancellations will take effect at the end of the current billing cycle, and Users will retain access until the end of that period.

6. Use of AI, Data Usage, and Ownership

6.1. Use of AI and Limitations

AIRES AI uses artificial intelligence (AI) to provide recommendations, insights, and other automated features.AI recommendations are for informational purposes only. Users are solely responsible for verifying and validating any AI-generated output before making business decisions.

6.2. Data Usage and Ownership

AIRES AI does not claim ownership of User data, but Users grant AIRES AI a limited license to process and analyze User data to deliver the Service.AIRES AI may use aggregated, anonymized data to improve and enhance the platform, but personal or proprietary business information will remain confidential.

7. Content and Intellectual Property

7.1. Ownership of Content

All software, tools, and materials within AIRES AI are the intellectual property of AI Real Estate Solutions.Users may not copy, modify, distribute, or create derivative works of any part of AIRES AI without express permission from AI Real Estate Solutions.

7.2. User-Generated Content

Users may upload content (such as property details or business data) to AIRES AI.By submitting content, Users grant AIRES AI a license to use the content in connection with delivering the Service.AIRES AI is not responsible for the legality, accuracy, or quality of User-uploaded content.

8. Service Availability and Interruption

AIRES AI may be interrupted for maintenance, updates, or other operational needs.AIRES AI makes reasonable efforts to maintain uptime, but no guarantee is provided for uninterrupted access.

9. Privacy Policy and Data Protection

Use of the Service is also governed by our Privacy Policy, which outlines how we collect, store, and process personal data.Users can review the Privacy Policy for more information on data rights under GDPR (for EU Users) and CCPA (for California Users).

10. Indemnification and Limitation of Liability

AIRES AI is provided "as is" without warranties of any kind, express or implied.The Owner is not liable for indirect, incidental, or consequential damages resulting from use of the Service.Users acknowledge that AI systems may produce incorrect, incomplete, or unexpected results, and AIRES AI is not liable for outcomes resulting from reliance on AI-driven recommendations.

11. Termination and Suspension of Access

AIRES AI may suspend or terminate User access for violations of these Terms, including misuse or unethical behavior.Terminated Users may lose access to content and data stored in their accounts.

12. Governing Law and Venue

These Terms are governed by the laws of the Owner's location. The exclusive jurisdiction for disputes lies with the courts of the Owner's location, except for European Consumers who have other protections.

13. Changes to Terms of Use

AIRES AI may update these Terms from time to time. Users will be notified of changes, and continued use of the Service constitutes acceptance of the new Terms.

14. Severability

If any provision of these Terms is deemed unlawful or unenforceable, the remaining provisions will remain in full effect.

15. Entire Agreement

These Terms constitute the entire agreement between Users and AI Real Estate Solutions regarding use of the AIRES AI platform.
